Adoption Process
Note - from what I can gather, Madagascar has been going through some changes since 2004 concerning the Hague Treaty.  I don't believe
adoptions are ongoing at the moment, but I could be wrong.  The following is a machine translation from

"It rests to the candidates to the adoption to know the child whom they wish to adopt before the constitution of their file. For that, adopting them have two different ways: the recourse at a French organization authorized for the adoption; the sending of a certified copy of approval for adoption to the service of the family and the Malagasy childhood which will communicate to you in return a list of orphanages and organizations occupying itself of children in Madagascar with which you will be able to make contact directly.

When the candidate with the adoption identified an acceptable child, a request for purposes of adoption addressed to the President of the Court of First Authority of the place of residence of the child, accompanied by the parts quoted below, will be conveyed by the means from the consular station in Madagascar (Coordinated at the end of the document) towards the Malagasy Ministry for Foreign Affairs which will communicate it to the interdepartmental Commission on the adoption.

FILE OF CANDIDATES A ADOPTION
· Home Study (social elaborate by the A.S.E.)
· Psychological Report/ratio worked out by the A.S.E.
· Birth certificate of each candidate;
· Marriage certificate;
· Certificate of celibacy, if necessary
· Copy family record book with systematic junction of the first page "child" (even if adopting them do not have a child).   If there are several children,
the copy of each page "child" will have to be produced;
· French certificate of registry for each of adopting - 1 original (delivered by the magistrates' court of their residence) and 4 cerifiées copies in
conformity;
· Medical certificate going back to less than three months attesting from the good health of each candidate
· Criminal extract of record (bulletin n° 3) going back to less than six months - 5 originals
· Certificate of morality delivered by the employer of each candidate
· Character reference delivered by a notary or, failing this, by a doctor
· Letter of introduction established by a religious authority ;
· Certificate of employment for each candidate
· last three payrolls (to be provided in the form of certified copies) or opinion of imposition or, if necessary, income and financial circumstances established by a notary or any other proper authority
· Engagement on the honor of the candidates to the adoption to accomodate the child after having been informed of the social report/ratio and
the medical file of the child
· Letter of the ESA committing itself to carry out, with the request or with the agreement of adopting, the follow-up of the child and drawing
up an annual report (for the candidates having chosen for an individual step)
· Engagement of the candidates to the adoption to declare the whole of the sums which will be spent for the realization of this adoption (maintenance costs, of procedure, lawyer fees);
· Photographs of adopting;

FILE of the CHILD
· Judgement back-up troop or birth certificate of the child;
· Certificate of unfruitful research established by the police force or the gendarmerie of the place of residence of the child;
· Certificate of residence of the child (if the child still domiciled in his biological family);
· Certificate of residence for the case where the child still domiciled in his biological family;
· Assent with the adoption of the biological parents of the child or his legal representatives, if necessary;
· Social report/ratio;
· Medical certificate;
· Certificate of registry;
· Court order of provisional guard (if the child is entrusted to other person that his biological parents);
· Photographs.

The file is to be constituted in 5 copies, of which one will be made up exclusively of original documents legalized (authenticated?). The 4 other files will include/understand the certified copies of the originals legalized and concerned, except for the criminal extracts of records, which will be provided in original in each 5 file.

As of the sending of their files, adopting them to the Mission International Adoption two photocopies of their approval accompanied by the information sheet must address. This step is taken by the approved organization, if necessary. Note: It is advisable to envisage important times for the transmission of the files by the Malagasy representations.

Local procedure - The Interdepartmental Commission on the Adoption has a three months deadline with the reception of the file to affix an opinion reasoned on the candidature. It is necessary that adopting them engaged, at this stage of the procedure, to have taken knowledge of all the parts of the
file and in particular of the documents concerning the child. The file is submitted by the Commission to the General Parquet floor close the Court of Appeal for purposes of continuation of the proceedings near the qualified Judicial bodies.

Note: The lawyer ministry is not obligatory during the procedure. The judgement is given in public sitting, then the judge orders the transcription on the registers of births, marriages and deaths and mention is made in margin of the birth certificate of the adoptee. Taking into account the operation of the Malagasy administration, the stay can be prolonged more than envisaged.

The presence in Madagascar of adopting parents is essential at the time of the achievement of the legal formalities. Certain jurisdictions can only accept
for a married couple the presence of the one of the two husbands. In this case, parents will have to make sure to the Malagasy authorities that one
the parents is present at the time of the legal and administrative formalities local like at the time of the handing-over of the child.

The methods of the representation of the couple will have to be specified in agreement with their lawyer, to which it will have to give a procuration that it is recommended to establish in front of notary. In any event, a minimum time several weeks on the spot is to be envisaged. After the expiry of the period of call of one month and transcription of the judgement on the birth certificate of the child to the town hall, adopting them will be able to obtain the establishment of the Malagasy passport of the child near the proper administrative authority and the authorization of exit of territory.
