I - LOCAL REQUIREMENTS

1. Reference texts - Adoption is recovering in Lebanese right of legislative competence and juridictionnelle religious communities acknowledged by the State, which guarantees " in populations, in whatever ritual they belong, the respect for their personal status and for their religious interests " (art 9 of Lebanese Constitution). As a result adoption is not subjected to an unique civil law, but is governed by the rules of the right of the religious acknowledged community to which belongs the adopting of Lebanese nationality.

The codes of the personal status containing dispositions relating to adoption are to the number of five. It is codes of the Catholic communities,
the Greek community - orthodox, from the community Armenian-Orthodox, from the Syrian community - Orthodox and from the evangelical community.   Indeed, the majority of the children adopted in Lebanon belong to the Catholic communities.

2. Requirements for adopting parents
- Must be more than 40 years old (Catholic communities, orthodox Armenian community). This age minimum does not seem to be requested in
       right Greeks-Orthodoxes and Protestant.
- Adoptive parents,  in all communities, should not have, in the day of adoption, legitimate derivation (natural children?).
- Age differences between adoptive parents and child have to be the following :
      in 18 years, in the right of the Catholic, Greek communities - Orthodox and Protestant,
      in 15 years in the right of the orthodox Armenian community.
- The membership of adopting parents and adoptive child should be the same religious community  (Catholic communities and Armenian-Orthodox).
- No one being able to be adopted by several, if it is not by two couple, the common law husbands cannot adopt (Catholic communities). (Married?)
- The candidacies of divorced persons are not accepted.
- According to the right of the Catholic communities, it is impossible to parents to adopt their natural children.

3. Requirements relating to the adopted child
- alone children under 18 can make the object of an adoption.
- the consent of the parents or the guardian of the child under 18 is demanded.
  - In the right of the Catholic communities, consent of adopted minor is besides demanded, if he is gifted with judiciousness.

4. Requirements relating to competent authorities and to local intermediaries

Appeal has a French allowed organism am not obligatory. It gives however a bigger insurance as for the good sequence of the procedure of
adoption in this country where there is not local organism loaded with the exam of the files of candidacy.   (Don't need an agency)

Some day nurseries gather the most part of the abandoned children, of whom the mother superior acts as lawful guardian of these children. The
children taken care by these day nurseries are however seldom acceptable.

The attention of adoptants is attracted to the activities of not very conscientious intermediaries, among which some people ask for sums without
common measure with real expenses of procedure, or even deceive adoptants on state of health and/or on registry office of the child. The article 500 bis of Lebanese Penal code suppresses these practices.

II - TYPE OF DECISION

1. Form of decision - decision returned by local religious authorities is a judgement of the religious, comparable court in a simple adoption of French law.

2. Effects of decision :
*Creation of a link of filiation between the adopted child and the adoptive family.
* Assertion of the link of filiation between the child and his family of origin.
* Adoptions pronounced in Lebanon are revocable in case of violation of regulation procedures. But revocation is specifically envisaged only
     by the right of the Catholic communities; it is pronounced by ecclesiastical jurisdiction. However, revocation is of right when the adopted child asks
     for it within one year as from his majority.

III - PROCEDURE

1. Constitution of the file in France - The candidates for adoption first have to send a letter of candidacy to one of the day nurseries whose coordinates appear in annex. If their candidacy is kept, it will be pointed out to them rooms necessary for the constitution of their file. From the dispatch of their file, it is up to the adoptants to address in the Mission of international adoption two photocopies of their amenity and the possible notice, issued by Social security benefits in Childhood accompanied with the duly supplemented chip of information. Point out : All the documents will have to be legalized by the office of the Legalization of the ministry of Foreign Affairs then by the consulate of Lebanon.

2. Local procedure - If one agrees to request, the child makes the object of a judgement of adoption returned by the religious jurisdiction of the community to which belongs the child. As regards the Catholic communities, if one agrees to request, the child makes the object of a judgement of the ecclesiastical court of the latin Apostolic Vicarage of Beirut. Point out : During the deliverance of the passport to the adopted children, adoptants is questioned by the General management of Lebanese general safety about the modalities of realization of their procedure of adoption. An inquiry can also be taught to different organisms and institutions intervened in this opportunity. The delays of deliverance of the passport can therefore prove to be comparatively long.
